User Agreement

This User Agreement explains the main terms that apply when you purchase products from PifPaf Shop through pifpafshop.com. Please read it carefully before placing an order.

This User Agreement works together with our Terms of Service, Privacy Policy, Cookie Policy, Shipping & Delivery page, Returns & Refunds Policy, and Customs, Duties & Import Taxes page.

1. Binding Agreement

By placing an order with PifPaf Shop, you agree to be bound by this User Agreement and by the additional policies referenced on our website.

This User Agreement constitutes a legally binding agreement between you, as the customer, and us. “Company,” “we,” “us,” or “our” means PifPaf Shop, operated by POHONCHUK LLC, a limited liability company registered in the State of Texas, USA, with company mailing address at: 2401 Fountain View Dr STE 464, PMB 2636, Houston, TX 77057, United States.

“Site” means the website available at https://pifpafshop.com. “Products” means products offered for sale on the Site, including bean bag chair covers and related soft furniture cover products.

You represent and warrant that you have the legal authority to enter into this User Agreement and that you have reached the age of legal majority under the laws and regulations of your jurisdiction. If you do not agree to this User Agreement, you may not purchase products from PifPaf Shop.

2. Our Products

PifPaf Shop sells bean bag chair covers and related soft furniture cover products. Unless a product page clearly states otherwise, our bean bag chair products are sold as covers only.

Filling is not included. Customers receive a compact cover and are responsible for filling it locally with suitable bean bag filling or another appropriate filling material.

We reserve the right to modify, update, discontinue, or change the selection of products offered on the Site at any time without prior notice. The same applies to product prices, descriptions, photos, materials, colors, specifications, and availability.

We make reasonable efforts to display product photos, colors, textures, sizes, and materials accurately. However, we cannot guarantee that your device screen will display colors or fabric textures exactly as they appear in real life. Product appearance may vary depending on screen settings, lighting, fabric batch, filling method, and normal production differences.

Product photos, lifestyle images, mockups, size references, and display examples are provided to help customers understand the product style, shape, and intended use. They do not guarantee exact final appearance after filling.

3. Purchasing from Us

You do not need to create an account to purchase products from PifPaf Shop. However, you may choose to provide or save certain information for easier checkout or customer support where such functionality is available.

By placing an order, you confirm that all information you provide is accurate, complete, and up to date, including your name, email address, shipping address, billing information, phone number where provided, and product selection.

You are responsible for reviewing your order before submitting it. This includes checking the selected product, quantity, size, color, shipping address, and any customization details where applicable.

Payment must be completed through the payment methods available at checkout. Order processing may begin only after payment is successfully authorized or received.

We reserve the right to refuse, cancel, review, or limit any order if we suspect fraud, payment issues, incorrect information, pricing errors, unavailable products, shipping restrictions, abuse of the Site, violation of this User Agreement, or any other issue that prevents proper order processing.

4. Order Cancellations, Returns, and Refunds

Returns, refunds, exchanges, damaged items, incorrect items, and cancellations are handled according to our Returns & Refunds Policy.

Any order that is not custom or personalized should be canceled before it is shipped. If your order has already been dispatched, it can no longer be canceled, but you may request a return under the conditions described in our Returns & Refunds Policy.

To be eligible for a return, the item must generally be unused, in the same condition in which you received it, and returned in the original packaging. Returns sent without prior authorization may not be accepted.

Customers are responsible for return shipping costs unless the return is due to our error or the item arrived damaged, defective, or incorrect.

Certain products, including customized, personalized, clearance, or final sale products, may not be eligible for return or may be subject to special return conditions.

If you receive a damaged, defective, or incorrect item, please contact us as soon as possible. We may ask for photos to better understand the issue and determine the appropriate solution.

5. Shipping and Delivery

Shipping times, dispatch estimates, tracking information, delivery conditions, and destination-specific guidance are described on our Shipping & Delivery page.

PifPaf Shop serves customers in the United States and selected international markets. Products may be prepared, fulfilled, or shipped from outside the customer’s country depending on the product, availability, and fulfillment process.

Delivery dates are estimates and are not guaranteed unless explicitly stated in writing for a specific order. Delays may occur due to production time, customs processing, carrier workload, weather, holidays, peak shipping periods, incorrect address information, technical issues, or other circumstances outside our control.

You will receive tracking information when it becomes available. Once an order is handed to a carrier, delivery progress may depend on the carrier, customs authorities, and local delivery services.

6. Customs, Duties, and Import Taxes

International orders may be subject to customs duties, import VAT, GST, local taxes, postal fees, courier handling fees, brokerage fees, or related charges depending on the destination country and local regulations.

Unless we clearly state otherwise for a specific destination, order, or shipping method, the buyer is responsible for any local import charges applied by their country.

We do not control customs authorities, import rules, duty calculations, parcel inspections, clearance delays, or local tax decisions. Customers are responsible for checking any import requirements that may apply in their country before placing an order.

7. Licenses and Intellectual Property

The Site, product presentation, product photos, designs, graphics, videos, logos, icons, text, page layouts, descriptions, and other content are owned by or licensed to PifPaf Shop unless otherwise stated.

Your purchase of a product does not grant you any rights to use, copy, reproduce, distribute, modify, resell, publish, or commercially exploit our website content, product designs, brand materials, images, or intellectual property.

Subject to your compliance with this User Agreement and our Terms of Service, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes, including browsing products, placing orders, and contacting customer support.

8. Restriction of Use

You agree to use the Site and products only for lawful purposes and in accordance with this User Agreement, our Terms of Service, and all applicable laws and regulations.

You must not use the Site to submit, upload, distribute, or transmit any material that is unlawful, harmful, threatening, defamatory, obscene, abusive, discriminatory, fraudulent, infringing, or otherwise objectionable.

You must not:

• copy, modify, duplicate, scrape, or create derivative works based on the Site or its content;
• republish, download, display, transmit, or distribute any portion of the Site except as permitted by normal Site functionality;
• attempt to access accounts, servers, systems, content, or data not intended for you;
• reverse engineer, decompile, disassemble, or attempt to derive the source code, structure, or architecture of the Site;
• probe, scan, test, overload, flood, spam, mail-bomb, crash, or otherwise interfere with the Site or related networks;
• use bots, crawlers, scrapers, automation tools, or similar technology without our prior written permission;

We reserve the right, in our sole discretion and without liability to you, to refuse, suspend, or revoke your access to the Site, cancel orders, or take other appropriate action if we believe your conduct violates this User Agreement, our Terms of Service, the rights of others, or applicable law.

9. Third-Party Services and Content

As part of the purchase process and website experience, certain third-party services may be used or suggested to you. These may include Shopify, payment processors, shipping carriers, tracking services, analytics tools, advertising tools, customer support tools, or external websites.

Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for the content, performance, availability, policies, errors, delays, security, or actions of third-party services that we do not control.

10. Availability and Force Majeure

Circumstances outside our reasonable control may cause delays, interruptions, or inability to provide access to the Site, process orders, prepare products, ship products, or provide customer support.

Such circumstances may include natural disasters, war, military action, civil unrest, acts of terrorism, strikes, fires, floods, pandemics, epidemics, cyber incidents, technical failures, carrier disruptions, customs delays, government restrictions, supplier issues, acts of third parties, or similar events.

We are not liable for delays, failures, interruptions, losses, or damages caused by events outside our reasonable control.

11. Indemnification

You agree to indemnify, defend, and hold harmless POHONCHUK LLC, PifPaf Shop, and their owners, employees, contractors, suppliers, partners, service providers, and affiliates from and against claims, demands, losses, liabilities, damages, costs, and expenses arising from:

• your violation of this User Agreement;
• your misuse of the Site or products;
• your violation of applicable law;
• your infringement of any third-party rights;
• fraudulent, abusive, or unauthorized use connected to your account, order, or information.

12. Limitation of Liability and Warranty Disclaimer

To the maximum extent permitted by law, the Site, Site content, and products are provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement, except where such rights cannot be excluded under applicable consumer protection laws.

We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free. We do not guarantee that any errors will always be corrected immediately.

To the maximum extent permitted by law, POHONCHUK LLC and PifPaf Shop are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of use, loss of data, lost profits, delivery delays, inability to use products, or reliance on information displayed on the Site.

In no event shall our total liability to you exceed the amount actually paid by you for the product that is the subject of the dispute.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.

13. Severability and Waiver

If any provision of this User Agreement is found to be invalid, unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted, and all remaining provisions shall remain in full force and effect.

Our failure to enforce any provision of this User Agreement shall not be considered a waiver of that provision or of our right to enforce it later.

14. No Offer in Unavailable Locations

The Site may be accessible internationally and may contain references to products, services, shipping methods, or offers that are not available in every country or region.

These references do not mean that we intend to make every product, service, or shipping method available in every jurisdiction. Availability may depend on local rules, carrier availability, checkout options, product availability, and business decisions.

15. Modifications of this User Agreement

We may update, modify, or replace this User Agreement at any time. Changes become effective once posted on this page, unless a different effective date is stated.

Your purchase of products or continued use of the Site after changes are posted means that you agree to the revised User Agreement.

No modification to this User Agreement by you is valid unless it is expressly agreed to by us in writing.

16. Termination

This User Agreement remains effective unless and until terminated by either you or us.

We may suspend, restrict, or terminate your access to the Site or our services if we believe that you have violated this User Agreement, our Terms of Service, or applicable law, or if your use of the Site is harmful, fraudulent, abusive, or unauthorized.

Any rights or obligations that by their nature should survive termination shall remain in effect, including payment obligations, intellectual property rights, liability limitations, indemnification, dispute resolution, and provisions related to returns or refunds where applicable.

17. Disputes and Governing Law

These User Agreement terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

If a dispute cannot be resolved informally, it shall be handled in accordance with the competent courts or dispute resolution procedures available under applicable law in Texas, United States, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

18. Class Action Waiver

To the extent permitted by law, you and we agree that any dispute shall be brought on an individual basis only, and not as a class, collective, representative, or private attorney general action.

There shall be no right or authority for any dispute to be brought, heard, or resolved as a class, collective, representative, or private attorney general proceeding, except where such waiver is prohibited by applicable law.

19. Entire Agreement

This User Agreement, together with our Terms of Service and policies referenced on the Site, constitutes the agreement between you and us with respect to purchasing products from PifPaf Shop and supersedes any prior or contemporaneous communications or understandings relating to the same subject matter.
